Meanwhile pressure is being mounted on the governor to resign. But the governor has taken the stand that he need not resign merely because FIR has been registered against him. Meanwhile he made several attempts to save his position. He persuaded senior advocate Ram Jethmalani to come to Jabalpur, seat of the High Court, to plead his case. Before filing his petition he camped in Delhi for more than four days. During his stay in Delhi he tried to get an appointment with the President. But President did not oblige him. Meanwhile Congress has made renewed attempt to pressurize him to step down. KK Mishra, chief spokesman of the State Congress asserted that for the first time in the history of Indian Republic, an FIR was lodged against the governor by Special Task Force (STF) of the state police. Yet, it was Governor Ramnaresh Yadav, accused of fraud, criminal conspiracy and corruption by the state police, who signed the notification for convening the budget session of the state assembly and its premature sine dine adjournment, he added.
Mishra further said that the constitution provides for state council of ministers to advise the governor in discharge of his duties, but in MP, governor has filed a petition in the high court against his own government for quashing of the FIR registered against him. 'Does this situation not indicate towards break down of constitutional system in the state? he asked.
Mishra reiterated that the high court's latest observation about Special Investigation Team (SIT) has come as a blow to those pinning hopes on SIT to ensure them justice in the matter. He said after the High Court constituted SIT, investigation into the PEB scam has picked up and unlike the STF, SIT appeared to be sincerely working to bring out complete truth in the scam. But after the High Court described SIT as 'watchdog and a postman', it will be difficult for the team to pursue the truth. 'If Special Investigation Team can't investigate into an issue it required, what is the propriety of having a SIT,' Mishra asked.
He further said that additional advocate general Pushpendra Kaurav, who appears in the PEB scam case on behalf of the state government, had described SIT as a link between STF and the high court, but following the High Court's latest observation, there should be a fresh interpretation of its role in the entire matter.
Mishra emphasised that Congress and all 'responsible' citizens of the country have doubt over the ability, integrity and dexterity of STF, a force under the control of Shivraj Singh Chouhan, to dig out complete truth in the scam and in such a situation, how could they be expected to hand over evidences and documents to this agency itself for scrutiny and verification.
Besides raising constitutional and legal issues Congress has planned series of events to apprise the people about the truth of MPEB scam. With this objective in view the Congress held second 'Khula Manch' programme in Sagar, which is the seat of Division Commissioner. The first 'Khula Manch' programme was held in Bhopal. Bhopal Khula Manch (Public Forum) was also addressed by leaders of CPI and CPM and some independent persons. All the speakers at the manch demanded a CBI enquiry in the scam.
While Congress is continuous to mount pressure both on the governor and the chief minister BJP is hurling charge of corruption and commitment of irregularities against Digvijaya Singh who is leading the Congress campaign against Chief Minister Shivraj Singh. BJP has discovered a diary of a well-known builder. The diary mentions that a sum of Rs. ten crores was given to Digvijaya Singh when he was Chief Minister. The bribe was given to Digvijaya Singh to seek some concessions for his deal. A BJP delegation met the Chief Income Tax Commissioner and demanded enquiry against Digvijaya Singh and the builder who also own a Hindi daily which is being published from many town of Madhya Pradesh.
The delegation of the Bharatiya Janata Party (BJP) leaders included state party president Nandkumar Singh Chauhan, Transport Minister Bhupendra Singh, Revenue Minister Rampal Singh submitted a memorandum in the name of chairperson of the Central Board of Direct Taxes asking him to reopen an old income tax evasion case in which former chief minister Digvijaya Singh's name allegedly figures.
Three diaries were recovered from the house of a builder during a search conducted on May 30, 2008. The BJP has claimed that separate entries by the builder prior to October 2003 referred to Rs. 10 crore paid to 'CM' and 'HCM'. The BJP has claimed that Digvijaya Singh was the chief minister and his statement should be recorded. Digvijaya Singh had on February 16 alleged that chief minister Shivraj Singh Chouhan had a role in the professional examination board (PEB) scam. He had complained to the SIT that entries bearing words 'CM' were deleted from hard disk confiscated from prime accused Nitin Mohindra.
After Digvijaya Singh's complaint to the SIT, the BJP launched a counter offensive against the Congress leaders. On BJP's complaint the Jehangirabad police station had registered a case against Digvijaya Singh and former speaker Sriniwas Tiwari. Both have been accused of flouting rules in appointment in the MP Vidhan Sabha secretariat between the years 1993 and 2003. On March 14, state BJP president had convened a press conference where he said diary entries had suggested that Digvijaya Singh had received money from the builder.
On Monday, while presenting the memorandum, BJP leaders said the case should be reopened under section 148 of the I-T Act and statement of the then chief minister be recorded under section 133(6). Meanwhile many people point out that though under rules which protect governor from any criminal action against him on moral grounds governor should step-down. It is also surprising that the Prime Minister Narendra Modi who during his election campaign repeatedly declared that he will not allow any corrupt person to hold any office, is keeping quiet on the Madhya Pradesh episode. There is every reason to believe that the BJP both at the centre in the state is trying to protect the governor. Why they are doing so is a mystery. (IPA Service)

BHOPAL: Madhya Pradesh is passing through a very serious crisis. The crisis is not only constitutional but also moral. According to the constitutional provisions administration of a state is run by the governor on the advice of the council of Minister. But at present the police which is under his control has lodged a First Information Report against him. The governor, on his part has moved the State High Court with the request that the FIR against him should be quashed. Obviously governor's petition is against his government. Thus the state police has initiated criminal charge against the governor and the governor has taken legal step against the state government. Thus it can be construal that he has filed a petition against himself.
