The Supreme Court approach of applying the principle of ‘the heart, mind and healing’ in its Ayodhya verdict has gladdened the hearts of millions of Ayyappa devotees, who are waiting desperately to hear the court deliver its judgment on a spate of review petitions on Thursday.

The most significant aspect of the Supreme Court verdict on Ram Janambhoomu-Babri Masjid dispute is that for the first time a court of law has given recognition to a mythological figure as a juridical person by tacitly accepting that what is believed to be the birthplace of Lord Rama is, indeed, his birthplace. This has serious implications for the future. Law has always differentiated between belief and evidence – evidence that is admissible in a court of law under the Indian Evidence Act. Recognizing belief as evidence opens a Pandora’s box. There is no evidence to show that Lord Rama was a person of flesh and blood and not a mythological figure who was born at a certain place.

Since the announcement of the historic verdict regarding the Ram Janmabhoomi-Babri Masjid dispute in Ayodhya by the constitution bench of 5 judges led by CJI Ranjan Gogoi unanimously, there have been opinions from a section of intellectuals and some politicians that the verdict is based on faith — not on law. They allege, as the constitution of India enshrines secularism, this verdict, that is majoritarian in nature, goes against the very basic values of it. Those who untill before the day of judgement clearly viewed judiciary as the only solution to this very controversial issue that polarised the Indian politics and society, started criticising the apex court by saying that “Supreme Court is supreme but it is not infallible” — and are trying to forecast all those repeated “doomed prophecies of danger in the upcoming days for minorities and secularism in the country.”

On 8th November, 2019, around 8.30pm news came out that the much awaited decision of the Supreme Court in the title dispute relating to a plot of 2.77 acres of land in Ayodhya on which Babri Masjid once stood, before it was dastardly brought down by Hindutva goons on 6th December, 1992 was to be delivered next day, i.e., on 9th November, 2019. Being a Saturday (9th November), when the Supreme Court is usually shut, it was an unusual event that a judgment of this magnitude would be given. The knowledge of the impending judgment made me feel utterly scared that our worst fears would come true. This article is not a legal analysis of the 1045 pages of judgment written by, in fact, NO ONE, since the judgment is silent on its author(s), even though 5 judges of the Supreme Court led by the CJI, Ranjan Gogoi, and our ostensibly liberal ‘woke’ judge, Justice D.Y. Chandrachud, heard the case on an urgent basis for 40 days.
