As the Twenty-sixth session of the Conference of the Parties (COP 26) is nearing, all eyes are set on India, the fourth largest greenhouse gas emitter of the world, the first being China, second United States, and the third the European Union. It is because the latest update released on October 25, 2021 by the UN Climate Change Office says the world is nowhere near the goal, and preventing destabilization of the world and endless suffering would require doubling of the climate change efforts. The wide difference between the rule of law and the rule by law cannot be bridged. In the rule of law the meaning and interpretation of law remains same in every case but interpretation of each law keeps shifting to suit needs of those in the power seat. For 60 years in the post independence era, though law was not misused but those in the power seat also did not attempt to eliminate the archaic rules like authority to detain any one on suspicions. Even today accusation by men in law enforcement agency converts in public eye the accused as criminal and the arbiters of freedom tend to accept the word of men in authority even in face of absurdity.
